Letter from Justice AK Ganguly

Retired Justice AK Ganguly, has finally sent a letter to the Chief Justice of the honorable Supreme Court by declining all the allegations against him. It should be noted that one law intern had accused justice AK Ganguly of sexual harassment and the Supreme Court had formed a three-member to committee to probe into the matter. Justice AK Ganguly has clearly questioned about the sanctity of the committee and the worth of their findings. The report of the intern was not handed over to him, though the excerpts have been published in several newspapers. AK Ganguly – the unending debate

The additional solicitor general, Indira Jaising disclosed the excerpts of the affidavit of the law-intern, which has fueled the issue of Ganguly’s resignation. The professed excerpts, published in a newspaper, have accelerated the momentum of the attack on retired Justice AK Ganguly, who has assumed the office as the chairperson of Human Rights Commission, West Bengal. TMC has been constantly screaming for his resignation, immediately after the allegation had become public. Most of the major political parties have also joined the fray. It was reported that AK Ganguly had been engaged in some undesired sexual harassment of a law intern last year in a hotel at Delhi. The excerpts of the affidavit indicate that AK Ganguly has been accused of kissing the law intern. The law intern had written her experience in her blog and finally the honorable Supreme Court had formed a three-judge committee to probe into the matter, who had reported in tandem as per the surfaced evidences. It is reported that the Apex court did not want to proceed with the findings any further for obvious reasons. It is indeed true that Justice Ganguly has been constantly denying the charges leveled against him and he has not resigned even in front of such dominant pressure from various corners. We ought to consider the entire episode on the backdrop of some apparent confrontations with the Government. During his tenure as the Supreme Court judge, some of his verdicts regarding 2G spectrum cases had gone against the central government. His verdicts as the chairperson of Human rights commission have always spread agonies to the state government. There is no surprise that a lot of lawyers have clearly stood by the retired Justice AK Ganguly. The list includes the reputed lawyer and former speaker Somnath Chatterjee, famous lawyer of Kolkata High Court, Arunava Ghosh and retired Justice Bhagabati Prasad. Some of them even believe that the party leaders have become vocal as they feel it is more important to toe the party line. Mamata Banerjee, the chief patron of TMC and the Chief Minister of West Bengal has sent two letters to the President requesting for the appropriate action. ASG Indira Jaising, has clearly demanded his resignation. Even the eminent leaders like Kapil Sibal or Arun Jaitley have been found to echo the same sentiments. They all believe that Justice Ganguly is the Chairman of Human Rights Commission, where the people expect their rights to be established. Pressure is stepping up on AK Ganguly

Paramount pressure for resignation has been stepping up on the retired justice AK Ganguly, but he still maintains his tough stance to stick to his chair. It is reported that the additional solicitor general, Indira Jaysinha has not only claimed his resignation from the post of chairperson of Human Rights Commission of West Bengal, but has gone one step ahead by writing a letter to the Prime Minister. It must be noted that AK Ganguly has been constantly demanding his innocence, which have been supported by the former speaker and reputed lawyer Somnath Chatterjee. Justice AK Ganguly is reluctant to resign

Battered by the accusation of a law intern regarding sexual harassment and its aftermath, Justice AK Ganguly has been found to lose his temper, when the journalists kept on asking him repeatedly about his resignation from the post of chairperson of Human Rights Commission, West Bengal. He had been heard of retorting back with the reply, “I am not going to resign”. However, after a leave of 4/5 days, he has assumed his office and attended the function related to Human Rights on Tuesday. AK Ganguly is in trouble

The allegation of the law intern against Retired Justice AK Ganguly has been accepted prima facie by the special three-judge committee of the Apex court. The committee has said that it was a “conduct of sexual nature” by AK Ganguly. The Supreme Court has also clearly mentioned that no further action is required as Justice AK Ganguly had retired on 24th December, 2012.
